Policies of Empower Fitness
Compliance and Rules
I understand and agree that a 24/7 gym membership is a special membership based on trust and is a privilege, which can be taken away for a violation of the policies or by Empower Fitness at any time of any reason at its sole discretion. As a gym member, I agree to abide by all of Empower Fitness membership policies, which are shared with me at enrollment and are posted on Empower Fitness website. These rules may be amended from time to time at the sole discretion of Empower Fitness.
Accessing the Facility
- Allowing non-members into the facility is strictly prohibited and will result in a fee of $70 per occurrence.
- Only active account members will be allowed entry.
- Misplacement of key fobs will result in a fee of $5 per occurrence.
- All key fobs must be returned to Empower Fitness upon cancellation of membership. If key fobs are not returned you will be charged a $5 fee per key fob.
- I agree to report any situation that appears to be unauthorized access to Empower Fitness staff.
Age Requirement
Pre-approved 24/7 members under the age of 16 must be accompanied by an approved member parent until they reach the age of 16.
Child’s Safety:
I understand that the safety of my child is my responsibility during the class, and I will closely supervise my child at all times.
No Supervision
I understand that I am purchasing a membership at a 24/7 facility that allows me the privilege to access the facility at any time. As such, I am aware that there will be no supervision or assistance except during staffed hours. I am aware that if I get injured, become unconscious, suffer a stroke, heart attack, or any other medical emergency or event that there may be no one to respond to my emergency and that Empower Fitness has no duty to provide assistance to me. I understand that even though Empower Fitness is equipped with surveillance cameras, these videos are not monitored continuously. The use of cameras does not, in any manner obligate Empower Fitness for any loss or damage, and any recordings are solely for the use of Empower Fitness. Help may not be available during non-staffed hours. However, a personal emergency panic button is available and fire extinguishers are available in open view beside the lockers near the front door. There is a second fire extinguisher in the group fitness room. The AED is clearly marked and visible attached to the wall across the bathroom. The first aid kit is clearly visible on a rack by the entrance.
Personal Property & Lockers
Empower Fitness is not responsible for any lost, stolen, or damaged personal property. Lockers are made available for daily use. Empower Fitness is not responsible for member vehicles and/or any damage or theft occurring in parking lots.
Damages to the Facility or Equipment
In the event that any damage to equipment or facilities occurs as a result of my willful actions, neglect, or recklessness, I acknowledge to pay Empower Fitness compensation to replace or repair the equipment or facilities to return them to their condition immediately prior to my use causing such damage.
Drugs and Alcohol
Members are not permitted to use Empower Fitness facilities while under the influence of drugs or alcohol.
Snow Removal/Weather Conditions
Snow removal will not be undertaken until staffed hours of operation. Members can utilize the facilities at their own risk.
General
This contract represents the complete understanding between you and Empower Fitness. No representations, written or oral, other than those contained in this contract are authorized or binding upon the gym. Should any part of this agreement due to legal or other regulatory changes become unenforceable, the remaining provisions within this agreement not impacted by such change shall remain in full force as originally written. You agree to promptly update the gym of any changes of address, phone, e-mail address and/or bank account/credit card information.
Other
- No use of sauna during unstaffed hours
- Unauthorized areas will be clearly marked and locked during non-staffed hours. Access to members to these areas is prohibited.
